Employee retaliation claims are soaring, tripling in fact between 1992 and 2009. The EEOC (Equal Employment Opportunity Commission) states that in 2010 retaliation claims exceeded race as the most-often-filed type of complaint and that retaliation claims now account for more than one-third of all EEOC complaints, making them its top priority.

While retaliation claims are employees’ legal right in the workplace, some experts say they are employers’ number-one risk. As such, it is critical that supervisors and managers clearly understand what retaliation is and how to avoid it. Simply put, when an employee accuses a superior of misconduct, it can be a challenge for the manager/supervisor to treat the employee impartially. But, taking adverse action against the employee — whether or not the underlying complaint has merit — can make the organization vulnerable to claims of retaliation.

Further complicating matters for organizations is that retaliation claims can be difficult to defend in court and settlements can be costly, reaching seven figures or beyond.
