Truth in Negotiations Act
Businesses and organizations that enter into a contract with the federal government for contracts in excess of $700,000 are required to provide the government all cost or pricing data that supports the agreed-upon contract price. This requirement is the law under The Truth in Negotiations Act (TINA). Congress passed the law in an effort to protect the government from paying inflated prices for contracts that lack adequate price competition, such as sole-source contracts.
Under this law, federal contractors must submit updated cost or pricing data throughout the negotiation process and, at the close of negotiations, officially certify that all data is current, complete and accurate. Thus, it is critical that all employees involved in the government contracting process understand and abide by TINA from start to finish.
